The customer declares to have carefully read and accepted the general terms and conditions before placing an order. The order validation then applies as agreement of the general terms and conditions.
Article 1 - Principles
The presented terms and conditions express in its entirety the parties’ obligations. In accordance with this, the buyer is considered to thoroughly accept them.
The presented general terms and conditions apply apart from any other conditions, especially the practical ones in stores’ sales and any other distribution or commercialization networks.
They are accessible on the ElloweenCreations website and will prevail, if required, on any other version or any other contradictory document.
The seller and buyer acknowledge the presented terms and conditions exclusively rule their relations. The seller reserves the right to occasionally change her terms and conditions. They will be practical as soon as they are uploaded.
If a selling condition happens to be lacking, it will considered as ruled by in effect distance selling field uses whose headquarters’ societies are located in France.
Article 2 - Content
The presented terms and conditions are subjected to define the parties’ terms and conditions within the scope of online sales’ goods proposed by the seller to the buyer, from ElloweenCreations website.
The presented terms and conditions only affect the purchases made on ElloweenCreations website.
These purchases affect the following products: handmade fashion jewelries and decorations.

The buyer acknowledges the statement, before placing an order and the contract conclusion, in an understandable and intelligible way, of the presented selling terms and conditions and every listed information in the French consumer code article L.221-5.
Are provided to the buyer, in a clear and understandable way, the following information:
- The goods’ principal features;
- The good’s price and/or price calculation way;
- If necessary, all shipping, delivery or postage additional costs, and eventually all others requiered costs;
- In immediate contract absence execution, delivery date or delay’s the seller engaged herself to deliver the goods whatever their price’s;
- The related informations of the seller’s identity, her address, phone and e-mail address, her activities details, those related to legal warranties, and to the warranties and others contractual conditions existence and use forms.
Article 4 - Order
The buyer has the possibility to order online, using the online catalog and with the present form, for any good while stocks last.
The buyer will informed about any good unavailability.
For the order to be approved, the buyer will have to accept, by clicking on the indicated place, the presented terms and conditions. They will also have to choose the address and shipping mode, finally confirm their payment method.
The sale will be considered as final:
- Once the buyer received the order confirmation mail by the seller;
- And after receipt of the price in its entirety by the seller.
Every order is worth acceptance of the prices and the in sale available goods’ description. Any contestation on this point will take action within the framework of an eventual exchange and hereinbelow quoted guarantees.
In some case, especially default on your payments, wrong address or any other problem on the buyer’s account, the seller reserves the right to block the buyer’s order through the problem’s solution.

Article 5 – Digital signature
The online supply of the buyer’s bank card number and the order’s final validation will be worth the buyer’s consent proof:
- Payment of the due sum of money in accordance with the order form;
- Signature and expressly acceptation of all made transactions.
In case of the bank card’s fraudulent use, the buyer is invited, as soon as the fraudulent use is discovered, to contact the seller with the following phone number :
Article 6 – Order confirmation
The seller supply the buyer an order confirmation by e-mail.
Article 7 – Transaction proof
The computerized registers, stored in the seller’s computer systems in sensible security conditions, will be considered as communication, order and payments proof occurred between the different parts. The order forms and invoices’ storage is made on a reliable and lasting material that can be produced as proof.
Article 8 – Informations about the goods
The products ruled by the presented terms and conditions are the ones featuring on the seller’s website and showed as sold and shipped by the seller. They are offered while stocks last.
The products are described and presented with the most accuracy possible. However, if mistakes or omissions occurred among this presentation, the seller’s responsability couldn’t be engaged.
The goods’ pictures are not contractual.
Article 9 - Prices
The seller reserves the right to change her in prices any time but is engaged to apply the in effect prices during the order, while stocks last on this day.
The prices are showed in euros (€). The shipping fees are not taken into account in them, charged as a supplement and indicated before the order confirmation. The in effect VAT is taken into account the day of the order and any change of VAT will be automatically transmitted on the online shop’s goods.
If one or several taxes or inputs, especially environmental, would happen to be created or changed, on the rise or decreasing, this change could be transmitted on the goods’ selling prices.
Article 10 – Payment method
It’s about an order with payment obligation, which means an order’s execution implies the buyer’s payment.
To pay their order, the buyer has, to their choice, all provided payment methods by the seller and listed on the website. The buyer guarantees to the seller they have the eventually necessary authorizations to use the chosen payment method during the purchase order validation. The seller reserves the right to suspend any order management and shipping in case of payment authorization’s refusal by bank card coming from officially accredited organisms or in case of non-payment. The seller eventually reserves the right to refuse perfoming the shipping or fulfil an order coming from a buyer who didn’t totally or incompletely paid a previous order or whom a payment dispute is ongoing.
The price’s payment is made in totality the day of order, according to the following methods:
- Bank card
- Paypal
If necessary, a calculated deposit according to the following method: 30% required of the total amount could be demanded during the order execution by the buyer, deposit is due in its entirety and in a single payment, according to the planned payment methods.
Apart from case of emergency, every order cancellation from the buyer as of 8 calendar days before the expected delivery date couldn’t lead to the anticipated deposit refund.
Article 11 – Goods availability – Refund – Cancellation
Apart from case of emergency or during the online shop’s closing period clearly announced on the website’s front page, the delivery times will be while stocks last, those showed below. The delivery times will in effect from the order confirmation day indicated on the order confirmation mail.
For deliveries in Metropolitan France and Corsica, the delay will depend of the chosen carrier as of the following day the buyer made their order, according to the available methods. At the latest, the delay will be 30 working days after the agreement conclusion.
For Overseas Departments and Territories deliveries or another country, the delivery ways and means will be explained to the buyer on a case-by-case basis.
In case of failure to respect the date or agreed delivery delay, the buyer will have, before terminating the contract, to enjoin the seller to perform it in a sensible additional delay.
In the absence of execution at the term of this new delay, the buyer could freely terminate the contract.
The buyer will have to fulfill these successive formalities by certified letter with return receipt requested or by written on another durable medium.
The contract will considered as resolved with the letter or written informing her of this cancellation reception by the seller, unless the professional complied in the meantime.
However, the buyer will be able to immediately resolve the contract, if the dates seen above constitute for them an indispensable contract condition.
In that case, when the contract is resolved, the seller is bound to totally refund the buyer all deposited sums, in the 14 days at the latest following the date the contract has been revoked.
In case of the ordered good’s unavailability, the buyer will be informed the soonest and will have the possibility to cancel their order. The buyer will then have the choice to ask for a refund of the deposited sums in the 14 days at the latest.
Article 12 – Delivery methods
The delivery includes the physical possession or a good control transfer. The ordered products will be delivered according to the methods and the precised delay above.
The products will be delivered to the indicated address on the order form, the buyer is asked to ensure the accuracy. Any resent package to the seller because of a wrong or incomplete delivery address will be resend at the buyer’s expenses. The buyer can, at their request, obtain an invoice at their billing address instead of their delivery address, by submitting the option in the space provided on the order form.
If the buyer is absent on the delivery day, the delivery man will leave a delivery notice in their mail box, which will permit them to collect their package on the indicated place and time.
At the time of the delivery, the packaging is damaged, torn, opened, the buyer must verify the goods state. If they are damaged, the buyer must absolutely refuse the package and write a reservation on the delivery form (refused package because opened or damaged).
The buyer must indicate on the delivery form and in the form of written reservations followed by their signature all anomalies concerning the delivery (damage, missing product compared to the delivery form, damaged package, broken products,…)
This control is considered as made once the buyer, or a person authorized by themselves, signed the delivery form.
The buyer will have to confirm by recorded letter their reservations to the carrier in the 2 working days at the latest following the goods reception and transmit a copy of this letter by normal mail to the seller at the indicated address in the terms and conditions.
If the products need to be returned to the seller, they must be the return request’s object to the seller in the 14 days following the delivery. Any complaint formulated beyond this time won’t be accepted. The returned good will only be accepted in their original state (wrapping, accessories, notice…) excluding the customized goods.
Article 13 – Delivery errors
The buyer will have to express to the seller the day of delivery or the next working day following the delivery, any error delivery complaint and/or non-compliance of the products in kind or in quality compared to the indications showing on the order form. All expressed complaint beyond this time will be rejected.
The complaint could be done with the following method:
- By e-mail on the following address: elloweencreations@gmail.com.
All complaint not effected in the defined rules above and the due dates won’t be taken into account and will absolve the seller of any responsability regarding the buyer.
After the complaint’s reception, the seller will attribute an exchange number for the concerned good(s) and will communicate it by email to the buyer. The product’s exchange can only be made after the assigned exchange number.
N.B: As all fashion jewelries and decorations are handmade and unique in the shop ElloweenCreations, no exchange will be possible unless it’s clearly written in the item’s description.
In case of delivery error or exchange, any product to be exchanged or refunded must be returned as a whole and in its original package to the seller, as a registered package, to the following address: Elodie ORTIZ 124 Boulevard Romain Rolland, 13010 Marseille.
The return fees are paid by the seller.
Article 14 – Products’ guarantee
14-1 Legal warranty of conformity
The seller is responsible for the sold good’s conformity to the contract, permitting the buyer to express a request in accordance with the legal warranty of conformity expected by the articles L.217-4 and following of the consumer code (French law).
In case of execution of the legal warranty of conformity, it is recalled that:
- The buyer benefits from a 2 years period as from the good’s delivery to act;
- The buyer can choose between the repair or the good’s substitution, under reservation of the cost conditions predicted by the article L.217-17 of the consumer code;
- The buyer doesn’t have to give proof of the good’s non-conformity during the 24 months in case of brand new goods (6 months in case of second hand goods), following the good’s delivery.
14-2 Guarantee for hidden lacks
In conformity with civil code, the seller is the articles 1641 and following the civil code (French law), the seller is responsible for hidden lacks affecting the sold good. It’s up to the buyer to prove the lacks existed during the good’s sale and naturally render the good unsuitable to its destined use. This guarantee must be used in a period of two (2) years as from the lack’s discovery.
The buyer can choose between the sale’s resolution or a discount in conformity with the civil code article 1644 (French law).
Article 15 – Right of withdrawal
Right of withdrawal application
In conformity with consumer code’s dispositions, the buyer has a 14 days period starting the order’s delivery date, to send back any item not suiting them and ask for the exchange* or the refund without penalty, with the exception of the return shipping fees at the buyer’s expense not including customized items.
The returned items must be done in their original state and complete (package, wrapping, accessories, notice…) permitting their remarketing as brand new, with the purchase bill.
The damaged products, dirtied or incomplete won’t be taken back.
The right of withdrawal can be practised online, using the withdrawal form available on this website. In this case, an acknowledgement of receipt on a lasting medium will be immediately given to the buyer. All type of withdrawal declaration can be accepted. It must be devoid of any ambiguity and must express the withdrawal will.
In case of right of withdrawal use in the above-mentioned period, will be refunded the price of the sold good(s) and shipping fees.
The returning fees are at the buyer’s expense.
The exchange* (subject to availability) or the refund will be done in 2 working days period, and at the latest, in a 14 days period after the receiving by the seller, the returned products by the buyer under the predicted conditions above.
*N.B: As all fashion jewelries and decorations are handmade and unique in the shop ElloweenCreations, no exchange will be possible unless it’s clearly written in the item’s description.
Exceptions
According to the article L221-28 of the consumer code (French law), the right of withdrawal can’t be applied for the contracts:
- Goods supplying which price depends of the financial market fluctuation being out of the professional’s control and likely to happen during the withdrawal period;
- The supply of goods made to the consumer's specifications or clearly personalized;
- Goods that spoil or perish quickly;
- Sealed goods that cannot be returned for health or hygienic reasons once they have been opened by the consumer;
- Goods which by nature are indissociably mixed after their delivery (ex. fuel) ;
- Alcoholic drinks whose price was determined when the sale contract was concluded, whose delivery cannot be completed within 30 days and whose value depends on the fluctuations of the market and cannot be controlled by the seller;
- Emergency repairs and maintenance work done on a home, as requested by the consumer;
- The supply of audio or video recordings or computer software which were unsealed by the consumer after the delivery;
- The supply of newspapers, periodicals and magazines, except for these publications subscription contract;
- Digital content that was not delivered in a tangible format, if the sale was executed with the express permission of the consumer, who understood they would lose their right of withdrawal (ex. downloads).
Article 16 - Force majeure
All circumstances independent of the parties’ will preventing the execution in normal conditions their obligations are considered as exemption causes of the parties’ obligations and will lead to their suspension.
The party appealing to the concerned circumstances above must immediately inform the other party of the occurrence, thus the disappearance.
Will be considered as force majeure all compelling fact or circumstances, external to the parties, unpredictable, inevitable, independent of the parties’ will and couldn’t be avoided by the latest, despite all possible sensibly efforts. Expressly, are considered as force majeure case or unforeseen circumstances cases, apart from those usually held by case law of French tribunals and courthouses: means of transportation or supplies blockage, earthquakes, fires, storms, floods, lightning, telecom network cessation or difficulties specific to telecom network external to the customers.
The parties will get closer to examine the event’s negative effect and consent of the conditions in which the contract execution will be pursued. If the force majeure case has an over 3 month period, the presented conditions could be cancelled by the prejudiced party.
Article 17 – Intellectual property
The website’s content stays the seller’s property, sole intellectual property rights holder on this content.
The buyers are committed to not use of this content; all reproduction, presentation, use or adaptation, in any form whatsoever, full or partial of these elements, are strictly forbidden and is likely to constitute a forgery.
Article 18 – Technology and freedom
The individual-related data supplied by the buyer are necessary for the order processing and invoice establishment. They can be communicated to the seller’s partners charged of the execution, processing, management and order payments.
The processing of communicated information by the intermediary of website ElloweenCreations is the subject of a statement with the CNIL.
The buyer has the right of permanent access, modification, rectification and opposition of the information regarding them. This right can be used according with the defined terms and conditions in the website ElloweenCreations.
Article 19 – Partial non-validation
If one or several stipulations of the presented terms and conditions are kept as invalid or stated as such under a law, a rule or as a result of a definitive decision from a competent court, the others stipulations will keep all their capacity and span.
Article 20 – No waiver
The fact any party to enforce any right or obligation with respect to any matter arising in connection with this contract shall not constitute a waiver as to that matter or any other matter either then or in the future.
Article 21 - Title
In case of difficulty of interpretation enter the one some of the titles appearing at the head of clauses, and the one some of the clauses, the titles will be declared non-existent.
Article 22 – Contract language
The presented general terms and conditions are redacted in French language and translated into English. In the case they are translated into one or several foreign languages, sole the French text shall be regarded as official in the event of dispute.
Article 23 – Mediation and dispute resolution
The buyer can have access to a conventional mediation, especially from the consumer mediation Commission or from existing sector instances for mediation, or with any alternative dispute resolution way (conciliation for example) in case of dispute. The mediator’s names, contact details and email are available on the needed websites.
According to the article 14 Regulation (EU) n°524/2013, the European Commission set up an online dispute resolution website, that facilitates independent regulation by extrajudicial way of the online disputes between consumers and professionals from the European Union. Article 24 – Applicable law
The presented terms and conditions are submitted to the French law application. The competent court is the judicial tribunal.
This is the case for the substantive rules as well for the rule of procedures. In case of dispute or complaint, the buyer will first and foremost addresses the seller to obtain an amicable solution.
Article 25 – Personal data protection
Collected data
The collected personal data on this Website are the following:
- Account opening: during the User’s account creation: name; first name; mail address; phone number, address;
- Connection: during the User’s connection to the Shop, it especially saves, their name, first name, connection data, use data, localization and their payment related data;
- Profile: the planned services use on the Shop allows to fill in a profile, including an address and a phone number;
- Payment: as part of the Shop’s proposed products and services payment, it saves financial data related to the User’s bank account or card;

Presented terms evolution
The Website reserves the right to make any modification to the presented clause relating to the personal data protection at any time. If a changed is made to the presented personal data protection clause, the Website commits to publish the new version on its platform. The Shop will also inform the Users by email in the minimum period of 15 days before the effect date. If the User doesn’t agree with the new written terms of the personal data protection clause, they have the possibility to erase their account.

Code de la Consommation
Article L. 217-4 : “Le vendeur livre un bien conforme au contrat et répond des défauts de conformité existant lors de la délivrance.
Il répond également des défauts de conformité résultant de l'emballage, des instructions de montage ou de l'installation lorsque celle-ci a été mise à sa charge par le contrat ou a été réalisée sous sa responsabilité.”
Article L. 217-5 : “Le bien est conforme au contrat:
1° S'il est propre à l'usage habituellement attendu d'un bien semblable et, le cas échéant:
- s'il correspond à la description donnée par le vendeur et possède les qualités que celui-ci a présentées à l'acheteur sous forme d'échantillon ou de modèle;
- s'il présente les qualités qu'un acheteur peut légitimement attendre eu égard aux déclarations publiques faites par le vendeur, par le producteur ou par son représentant, notamment dans la publicité ou l'étiquetage;
2° Ou s'il présente les caractéristiques définies d'un commun accord par les parties ou est propre à tout usage spécial recherché par l'acheteur, porté à la connaissance du vendeur et que ce dernier a accepté.”
Article L. 217-6 : “Le vendeur n'est pas tenu par les déclarations publiques du producteur ou de son représentant s'il est établi qu'il ne les connaissait pas et n'était légitimement pas en mesure de les connaître”.
Article L. 217-7 : “Les défauts de conformité qui apparaissent dans un délai de vingt-quatre mois à partir de la délivrance du bien sont présumés exister au moment de la délivrance, sauf preuve contraire.Pour les biens vendus d'occasion, ce délai est fixé à six mois.Le vendeur peut combattre cette présomption si celle-ci n'est pas compatible avec la nature du bien ou le défaut de conformité invoqué.”
Article L. 217-8 : “L'acheteur est en droit d'exiger la conformité du bien au contrat. Il ne peut cependant contester la conformité en invoquant un défaut qu'il connaissait ou ne pouvait ignorer lorsqu'il a contracté. Il en va de même lorsque le défaut a son origine dans les matériaux qu'il a lui-même fournis.”
Article L. 217-9 : “En cas de défaut de conformité, l'acheteur choisit entre la réparation et le remplacement du bien.Toutefois, le vendeur peut ne pas procéder selon le choix de l'acheteur si ce choix entraîne un coût manifestement disproportionné au regard de l'autre modalité, compte tenu de la valeur du bien ou de l'importance du défaut. Il est alors tenu de procéder, sauf impossibilité, selon la modalité non choisie par l'acheteur.”
Article L. 217-10 : “Si la réparation et le remplacement du bien sont impossibles, l'acheteur peut rendre le bien et se faire restituer le prix ou garder le bien et se faire rendre une partie du prix. La même faculté lui est ouverte : 1° Si la solution demandée, proposée ou convenue en application de l'article L. 217-9 ne peut être mise en œuvre dans le délai d'un mois suivant la réclamation de l'acheteur ; 2° Ou si cette solution ne peut l'être sans inconvénient majeur pour celui-ci compte tenu de la nature du bien et de l'usage qu'il recherche. La résolution de la vente ne peut toutefois être prononcée si le défaut de conformité est mineur.”
Article L. 217-11 : L'application des dispositions des articles L. 217-9 et L. 217-10 a lieu sans aucun frais pour l'acheteur. Ces mêmes dispositions ne font pas obstacle à l'allocation de dommages et intérêts.
Article L. 217-12 : “L'action résultant du défaut de conformité se prescrit par deux ans à compter de la délivrance du bien.”
Article L. 217-13 : "les dispositions de la présente section ne privent pas l'acheteur du droit d'exercer l'action résultant des vices rédhibitoires telle qu'elle résulte des articles 1641 à 1649 du code civil ou toute autre action de nature contractuelle ou extracontractuelle qui lui est reconnue par la loi."
Article L. 217-14 : "L'action récursoire peur être exercée par le vendur final à l'encontre des vendeurs ou intermédiaires successifs et du producteur du bien meuble corporel, selon les principes du code civil.
Article L. 217-15 : "La garantie commerciale s'entend de tout engagement contractuel d'un professionnel à l'égard du consommateur en vue du remboursement du prix d'achat, du remplacement ou de la réparation du bien ou de la prestation de tout autre service en relation avec le bien, en sus de ses obligations légales visant à garantir la conformité du bien.
La garantie commerciale fait l'objet d'un contrat écrit, dont un exemplaire est remis à l'acheteur.
Le contrat précise le contenu de la garantie, les modalités de sa mise en œuvre, son prix, sa durée, son étendue territoriale ainsi que le nom et l'adresse du garant.
En outre, il mentionne de façon claire et précise que, indépendamment de la garantie commerciale, le vendeur reste tenu de la garantie légale de conformité mentionnée aux articles L. 217-4 à L. 217-12 et de celle relative aux défauts de la chose vendue, dans les conditions prévues aux articles 1641 à 1648 et 2232 du code civil.
Les dispositions des articles L. 217-4, L. 217-5, L. 217-12 et L. 217-16 ainsi que l'article 1641 et le premier alinéa de l'article 1648 du code civil sont intégralement reproduites dans le contrat.
En cas de non-respect de ces dispositions, la garantie demeure valable. L'acheteur est en droit de s'en prévaloir."
Article L. 217-16 : “Lorsque l'acheteur demande au vendeur, pendant le cours de la garantie commerciale qui lui a été consentie lors de l'acquisition ou de la réparation d'un bien meuble, une remise en état couverte par la garantie, toute période d'immobilisation d'au moins sept jours vient s'ajouter à la durée de la garantie qui restait à courir.
Cette période court à compter de la demande d'intervention de l'acheteur ou de la mise à disposition pour réparation du bien en cause, si cette mise à disposition est postérieure à la demande d'intervention.”

Article 1641 : “Le vendeur est tenu de la garantie à raison des défauts cachés de la chose vendue qui la rendent impropre à l'usage auquel on la destine, ou qui diminuent tellement cet usage, que l'acheteur ne l'aurait pas acquise, ou n'en aurait donné qu'un moindre prix, s'il les avait connus.”
Article 1648 : “L'action résultant des vices rédhibitoires doit être intentée par l'acquéreur, dans un délai de deux ans à compter de la découverte du vice. Dans le cas prévu par l'article 1642-1, l'action doit être introduite, à peine de forclusion, dans l'année qui suit la date à laquelle le vendeur peut être déchargé des vices ou des défauts de co nformité» apparents.
